Personal Data Protection
This is to inform any person providing personal data to Barbora Šnáblová Attorneys (BŠAK) as a data subject with respect to what personal data are processed by BŠAK, for what purposes and based on what legal grounds, with whom we may share the personal data, how we protect the personal data, and what are the rights of the data subjects regarding their personal data.
We protect all the personal data processed by BŠAK in connection with the provision of legal services and carrying out our business activities, and we fully respect the rights of the data subjects regarding the personal data. BŠAK is a data controller within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).
Processed Personal Data
We may acquire your personal data during performance of our activities, in particular as part of providing legal services, namely if (i) we acquire your personal data during providing services to you or any of our clients (as a result of your relationship to our client); (ii) we acquire your personal data during providing services directly from you or from our colleagues or contractors; (iii) we acquire your personal data from other sources, including publicly available sources; and/or (iv) you contact us or request information from us.
The personal data processed by us will typically involve your name, date or place of birth, personal ID number, gender, permanent address or other place of residence, nationality, trade name, registered office, company ID number and tax ID number, information on personal ID or copy thereof, designation of your employer, your position or function, your contact details such as email address, phone number or postal address, bank account number and other payment details, and any information which you provide to us or any of our clients in connection with the provision of legal services to you or another client for the purposes of arranging a meeting, business trip, events, recruitment in BŠAK, etc, and any other personal data which we are provided with or otherwise acquire from third parties or other sources.
In exceptional cases, BŠAK may also process sensitive data within the meaning of GDPR. BŠAK shall process such sensitive data only if necessary and always in accordance with the law, in particular Article 9 GDPR.
If you provide BŠAK with any personal data of third parties, you are responsible for ensuring that the personal data is provided in accordance with the law and that you are entitled to provide such data to BŠAK for processing.
Purposes and Scope of Processing of the Personal Data
We are entitled to process your personal data for the following purposes: (i) provision of legal services and activities related to the conclusion and performance of agreement on the provision of legal services; (ii) the operation and administration of BŠAK; (iii) personnel activities, in particular in relation to recruitment; (iv) keeping records on BŠAK activities and performance of BŠAK obligations, in particular in the AML area, rules on advocacy, tax regulations, etc.; (v) promotion of BŠAK activities.
BŠAK always processes the personal data to the necessary extent and based on statutory grounds for processing, i.e. in particular, if processing is required (i) for the conclusion or performance of an agreement with the data subject; (ii) to comply with a statutory obligation of BŠAK; (iii) to protect the vital interests of the data subject or a third party; (iv) by the legitimate interests of BŠAK or a third party; or (v) with your consent as the data subject.
Recipients of Personal Data and Transmitting Personal Data
Based on the purpose of processing, BŠAK may share your personal data to the necessary extent with its employees, cooperating attorneys and other business partners, also in other jurisdictions, clients, tax advisors and accountants, experts, translators or interpreters, third parties monitoring the legal services market, couriers, and other parties providing services to BŠAK enabling BŠAK to provide legal services.
BŠAK may transmit your personal data if entitled or required to do so by operation of the law, in particular upon justified request of public authorities, in court or arbitration proceedings, etc. The data may even be transmitted to a person in a third country, should it be required by the purpose of processing of the personal data, e.g. in the case of cooperating with a law firm or expert in another country for the purposes of protecting your rights.
Security of Personal Data
For the purposes of protecting your personal data, we apply appropriate technical and organisational measures within the meaning of Article 32 GDPR; however, we may not be liable for the security of personal data during its transmission to BŠAK.
Storage of Personal Data
We shall archive your personal data for the time necessary to fulfil the purpose of processing such data, for the term prescribed by the law, and for a period until the expiration of a limitation or similar period relevant for the data.
Your rights as a data subject
You have the following rights regarding the personal data processed by BŠAK:
- Right of access, including right to obtain from us a confirmation as to whether or not we process your personal data, and if so, right to access such personal data and related information (Article 15 GDPR);
- Right to rectification of any inaccurate personal data concerning you, right to erasure of personal data and right to restriction of processing, if grounds for erasure or restriction exist (Articles 16 to 18 GDPR);
- Right to portability, i.e. to receive the personal data concerning your person, which you provided to us (Article 20 GDPR);
- Right to object against processing your personal data, which we will respect unless there will be compelling legitimate grounds for the processing which override your interests and rights (Article 21 GDPR);
- Right to withdraw consent to processing of the personal data, if we process the data based on your consent.
Our mutual rights and obligations regarding processing of your personal data are regulated in detail by GDPR and the Czech law regulating advocacy and provision of legal services. If you decided to exercise any of the above rights, please contact us at the address below, and we will process your request in accordance with the law and in the interests of you as a data subject. If any of your provided personal data change, please inform us of such a change, so that we may always process your data accurately and fully. We may not bear liability for accuracy or completeness of the data which you provide to us.
You are always entitled to file a complaint against processing of your personal data with the national authority, which is the Czech Office for Personal Data Protection.
